Commercial Debt Collection

Bay Capital Legal specializes in commercial debt collection and creditor’s rights related matters with an emphasis on disputes involving online/technology agreements and breach of “click-through” contract claims. BCL has represented creditors and has been successful in recovering millions of dollars for our clients.

We have a successful track record utilizing pre-litigation debt collection and litigation strategies for optimal return on time and resources. In the last four years, our clients have been awarded over $2.5 million dollars through Alternative Dispute Resolution methods, including arbitration and mediation.

Debt Collection and Investigation Services
Our services include recording, tracking, and collecting outstanding debts. Additionally, we conduct investigative searches, including assets, bankruptcy, and corporate status searches for each claim.

Litigation Services
We strive to resolve all claims through informal yet aggressive negotiations with the debtors or their attorneys. However, in some cases, filing a lawsuit is appropriate to enforce payment of debts.

Post Judgment Collection
Upon obtaining judgment through litigation, we can collect on judgments and have the ability to enforce judgments in sister states through our extensive network of other commercial collection attorneys, such as the Commercial Law League of America and American Lawyers Quarterly Directory.*

Bankruptcy Support
We assist clients with preparing and filing a proof of claim in a bankruptcy as well as represent clients’ interests as a creditor in recovering from the bankruptcy estate of the debtor.

Preventative Maintenance
We can draft commercial contracts and provide evaluation and recommendations to a client’s existing commercial contracts to help protect against future similar disputes resulting in debt. With our advice, in the future you may be able to avoid these problems before they occur.
